Montana Landlord-Tenant Basics for Billings Owners
Out-of-state owners who buy in Billings often bring another state's timeline with them. Montana writes its own rules — and winter makes slow processes feel slower when a vacant house still needs heat.
Nothing here is legal advice. Always check the current Montana Code Annotated, your lease, and a Montana attorney before you act.
What notice does a Montana landlord give for unpaid rent?
If rent is unpaid when due, Montana law lets a landlord give written notice that the tenant has 3 days to pay or the landlord may terminate the rental agreement. That rule is in MCA 70-24-422(2). A notice is not an eviction by itself. If the tenant doesn't cure and you move forward, you still have to follow the court process.
What about other lease violations?
MCA 70-24-422 sets different minimum notice periods depending on the problem:
- Unauthorized pet or unauthorized occupants: 3 days
- Most other remediable noncompliance: 14 days (and if the tenant cures in time, the lease does not terminate)
- Same problem again within 6 months: at least 5 days
- Serious damage or certain safety issues under the statute: 3 days
Read the statute for the exact categories. The point for owners is simple: Montana is not a one-size-fits-all "three-day everything" state for lease issues.
How do month-to-month terminations work in Montana?
Under MCA 70-24-441, either party can end a month-to-month tenancy with at least 30 days' written notice. Week-to-week tenancies need at least 7 days. That matters for Billings owners who roll leases to month-to-month and then decide to reclaim the unit — especially heading into winter, when a December vacancy can sit longer and cost more in utilities and freeze risk.
How fast must a Montana landlord return a security deposit?
Montana splits the answer. Under MCA 70-25-202:
- If there are charges (rent due, damage, cleaning after the statute's process), the landlord generally has 30 days after the tenancy ends (or surrender and acceptance) to send a written list of charges and any refund balance.
- If there are no damages, no cleaning needed, no unpaid rent, and the tenant can show utilities aren't unpaid, the deposit must be returned within 10 days.
MCA 70-25-201 also limits what you can deduct and requires written notice and a 24-hour chance to clean before most cleaning charges — unless the tenant left without notice or certain court-claim exceptions apply. Miss the process and you can lose the right to keep what you thought you were owed.
Why does this matter more in a Billings winter?
Cold weather doesn't change the statute. It changes the cost of getting it wrong. A vacant Billings rental still needs heat. Snow and ice create maintenance calls. Applicant traffic slows after the holidays. That's why notice timing, deposit process, and make-ready speed matter as much as the rent number on paper.
If you're comparing markets, South Dakota and Montana both allow short notices for unpaid rent in many cases — but deposit return rules and lease-violation notice periods are not identical. Don't copy a Rapid City playbook into a Billings lease without reading Montana's code.

Frequently Asked Questions
Is Montana landlord-friendly?
It depends what you mean. Unpaid rent can move on a 3-day written notice under MCA 70-24-422(2), but other violations often get longer cure periods, and deposit rules are specific. Compare the whole process, not one headline.
How many days for a Montana eviction notice for nonpayment?
For unpaid rent, the statute provides a 3-day written notice before the landlord may terminate. Court steps still follow. This isn't legal advice.
How long does a landlord have to return a deposit in Montana?
Often 30 days with an itemized list when deductions apply; 10 days when nothing is owed and utilities are clear, per MCA 70-25-202.
Do I need a Montana attorney for an eviction?
For filing and court work, yes — use a Montana attorney familiar with your county. Property managers coordinate; attorneys file.
We manage Billings rentals — does that include winter make-ready?
Yes. Vacant units still need heat, and we treat make-ready as part of protecting the asset. Our public repair promise is within seven days.
